These Terms of Use (the “ToU”) constitute a legally binding agreement made between you personally and/or on behalf of an entity you represent (collectively “You”) and Genco Seeds Private Limited (the “Company”), concerning access to and use of the website www.gencoseeds.comas well as any other media, mode/channel of trade, and/or application related, linked, or otherwise connected to the Website (collectively, the “Genco Platform”). By accessing, using, and continuing to access and use the Genco Platform, You acknowledge having fully read and understood this ToU as well as the Privacy Policy (LINK) and Disclaimers (LINK) (collectively, the “Legal Texts”, including their latest versions which shall be deemed to be incorporated herein by reference as and when updated by the Company from time to time), to which You unconditionally agree to be lawfully bound. If you do not unconditionally agree with the Legal Texts in their entirety, you are expressly prohibited from accessing and / or using the Genco Platform and you must discontinue all access and use thereof immediately, including deletion of Your account, if any created on said Genco Platform.

Placement of orders, payments, and pricing

1) By placing any order/s against one or more product listing/s on the Genco Platform, You shall be deemed to- (a) unconditionally accept the offer to sell embodied in said product listing/s to thereby enter a valid contract for sale, and (b) represent being of requisite lawful age and capacity to enter a binding contract with the Company; and c) having means and authority over the payment method opted/provided by You to thereby promptly complete the purchase transaction in relation to said order/s.

2) Prices of products enlisted on the Genco Platform are final and inclusive of the Company’s commission on sales and transaction fees, subject to promotional offers and discounts if any which may be applied at the discretion of the Company, but excluding shipping costs and taxes applicable as per state and central legislations and/or transaction charges levied by providers of the payment modality selected by You.

3) Payments against any order/s placed by You shall be paid in their entirety in advance by You to the Company via payment modalities including but not limited to net-banking, debit/credit card, electronic wallets, in-store credit, loyalty/gift cards or any other prevailing payment modes provided by the Company on the Genco Platform.

4) The Company, at any time at its own sole discretion and without the obligation to assign any reason or notice to You, shall have the exclusive discretion to- (a) Limit, modify, and/or refuse any order/s, or any part thereof, placed by You; (b) Substitute, modify, limit and/or discontinue any Vendor and/or content of any product listing/s, product descriptions, and pricing enlisted on the Genco Platform; (c) impose transaction limits or decline transactions that the Company has reasons to believe to include high risk, are fraudulent, or are in violation of these ToU; and/or (d) change the URL, layout and/or user interface of the Genco Platform for any reason including better user experience.

Cancellation and refund policy

5) You may cancel any order/s placed by You on the Genco Platform at anytime, without any costs, before dispatch of said order/s for delivery by the Company and / or concerned vendor/s of the product/s included in the order/s, but not after the product/s included in the order/s have been dispatched for delivery by the Company and / or concerned vendor/s whereupon completion of the transaction of sale shall be binding on You.

6) Order/s placed on the Genco Platform shall be confirmed upon receipt in full of payment therefor, and shall carry a defined period of time as a return window, solely during which You may return and claim replacement product/s or refund of payment made against said order/s, and beyond which window the Company shall not entertain any returns / claims for refund whatsoever. Replacement shall exactly mirror the products listed in any concerned order and shall not be convertible to any other products or cash anytime.

7) Refund of any payment received by the Company from You shall be made within 30 (Thirty) Days to You, subject to deduction of any direct expenses and / or shipping costs involved therein, in exact amount paid by You and by reversing the same modality of payment implemented by You or alternatively offered as in-store credit if opted for by You, but in no event shall any refunds be convertible, transferrable, or redeemable in terms of cash or any other modality of credit whatsoever.
